In this week’s episode, we will do things a little different. I’ll answer the top five questions I get from listeners about being an expert witness. People have a cursory understanding of what being an expert witness is all about because of what they watch on TV or movies. An expert witness is not an eye-witness. An expert witness is a specialist in a given technical subject that the average person does not know at the same level the expert knows. The expert gives his opinion based on his knowledge, education and years of experience. As an expert witness, you give your opinion based on the facts of the case. You help to explain something that’s technical or that is not common knowledge to the jury. Expert Witness Firing - Discrimination

Today we will be talking about expert witness – information & stories on firing, particularly around discrimination. Employees need to know their rights and what they are entitled to under the law, whether in regards to their work, leave benefits, or compensation. They need to know when their rights are or aren’t being violated. Employers, on the other hand, have to make sure that their policies are current and aligned with the law. The policies must be enforced equally among all employees. If one person does something & has to be disciplined or terminated, then everybody else should be handled the same way. If you pick out one person & give him a hard time, then it becomes problematic. Crazy Termination Stories - Weapons and Stalking

This week’s episode is going to be about stalking & employees coming to the office carrying weapons. Weapon policies, especially these days, are very necessary in the workplace. You can get a permit to carry your weapon, but even then there are restrictions on whether or not you can bring it to work and other public places. Regina has had to be called in several times in one of the agencies she worked for because of complaints that someone had a weapon. The agency did not have a weapons policy. Some employees with hand guns took advantage of that, even though they were not police officers. They had permits to carry them around and so would bring them to work. In this week we talk about employees lying & committing fraud. We discuss time card fraud, payroll systems, off duty conduct, and gathering evidence for a case. Just because others in the workplace are lying doesn’t mean that the employee is not guilty. As the HR department, when you get tipped off about something, you have to do your duty to investigate & gather more information about the case. It involves a lot of back & forth with the supervisor & unit before even bringing in the employee to give his statement. This is to get more information. Crazy Termination Stories - Stealing

Bombthreats. Workplace Violence. People using a conference room as a bedroom. In HR, you see it all. But one area of concern that Human Resources professionals have to deal with from time to time is employees who steal. In this episode, we discuss employees stealing – how to spot it, what to do when it happens, and how to handle it. We also discuss the story of a particular supervisor who was overseeing part time student workers in a workplace. The supervisor instructed the student workers to give him their password so he could have it when the student workers were not in the office. After he gave him their passwords, he logged in and diverted small amounts of money into his personal account. Overtime, he embezzled hundreds of thousands of dollars and had event purchased a house with the stolen money. Crazy termination stories - Turning the conference room into the bedroom

Bombthreats. Workplace Violence. People using a conference room as a bedroom. In HR, you see it all. In this episode, we talk about dating co-workers, workplace romances, and terminations. Workplace dating and romances often end in one of 2 pieces of paper: either a marriage license or a restraining order. It doesn’t have to be that somebody has actually done something for you to get a restraining order. You can go before a judge & present evidence that shows that the person could be potentially violent. In most employment contracts, whether implied or explicit, there’s a morality clause.
